Justice Chacha Mwita has directed the Inspector General of Police, Douglas Kanja, and the Directorate of Criminal Investigations (DCI) boss, Mohamed Amin, to produce missing blogger Ndiang’ui Kinyagia before the court, whether dead or alive. 

Speaking on Tuesday, July 1, Mwita stated that it is humanly impossible for Kinyagia to leave his house and vanish without a trace.

"I want Ndiang’ui Kinyagia in court, whether dead or alive. I'm also speaking to these people (Kanja and Amin), there is no way a Kenyan would get out of his aboard and vanish from this world without trace; it is not humanly possible. Let's stop playing drama and stick to what our Constitution speaks to," he said.

Mwita pointed out the seriousness of the matter, stating that the focus should be on locating the blogger rather than indulging in theatrics.

"All we want is this Kenyan; where is he? Nothing more. We are not interested in drama or anything; we have a human being missing. The responsibility is now on me, they are looking upon this court to get this person alive or dead," he added.

On Monday, June 30, Amin said that Kinyagia is not in police custody, however, acknowledging that he is being sought for questioning over controversial online posts ahead of the June 25th protests. 

“Ndiagui Kinyagia was a person of interest to us after publishing inflammatory content on social media. Our primary investigations established that the social media account belonged to Ndiagui. We profiled him, we identified his residence, and our officers conducted a search at his apartment in Kinoo," he said.

According to the DCI boss, the blogger was not found at his residence during the search, but the police managed to seize several items that could aid in their investigations.

“Unfortunately, he was not in his apartment, but we managed to conduct a search, recovering an assortment of electronic gadgets that we believe would be useful to us in our investigations.

“Mine is to confirm to Kenyans that Ndiagui is not under the custody of the National Police Service (NPS), he is a person of interest to us, and wherever he is, I would urge that he surrender to the nearest police station,” he further said.
